1. Agreement to Terms

By accessing or using MyOwnBiz ("the Service"), operated by MyOwnBiz LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MyOwnBiz provides cloud-based scheduling, customer management, invoicing, and business management software for independent service professionals and small businesses ("Subscribers"). Each Subscriber receives a branded application accessible via a unique URL.

3. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service. You are responsible for all activity that occurs under your account.

4. Free Trial

New accounts receive a 30-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial, your account will be suspended unless you upgrade to a paid plan. Your data will be retained for 30 days after suspension, after which it may be permanently deleted.

5. Pricing and Payment

Paid plans are billed monthly at the rate displayed at the time of subscription. Prices may change with 30 days' notice. All payments are processed securely through Stripe. Refunds are available within the first 14 days of a paid subscription.

6. Your Data — Ownership and Control

You own your data. All customer information, job records, invoices, and other business data you enter into MyOwnBiz belongs to you. We do not claim any ownership rights to your data.

We strive for 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any loss of revenue, missed appointments, or business disruption resulting from service downtime.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYOWNBIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE.

You are solely responsible for your own business operations, tax obligations, licensing requirements, and compliance with all applicable local, state, and federal regulations. MyOwnBiz is a software tool and does not provide legal, tax, or business advice.

11. Indemnification

You agree to indemnify and hold harmless MyOwnBiz, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate at any time. You may cancel your subscription from your account settings. We may suspend or terminate your account for violation of these Terms with reasonable notice. Upon termination, you may request a data export within 30 days.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.
